Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Deflector's bot-detection and content-poisoning platform (“Service”), operated by Deflector, Inc. (“Deflector”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & Account
You must be at least 16 years old and have the legal capacity to enter into a binding contract to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
2. Acceptable Use
You may use Deflector only on websites and properties that you own or are authorized to protect. You must not:
- Use the Service to target individuals or organizations without authorization
- Attempt to circumvent, disable, or interfere with the Service or its security features
- Resell or sublicense access to the Service without our written consent
- Use the Service in any way that violates applicable laws or regulations
- Generate content through the poisoning feature that is defamatory, illegal, or harmful
- Reverse-engineer or attempt to extract source code from the Service
We reserve the right to suspend or terminate accounts that violate these rules without notice.
3. Plans & Payment
Subscriptions
Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law or as explicitly stated in our refund policy. Prices are subject to change with 30 days' notice.
Free Plan
The Free plan is provided as-is without any service-level commitments. We may modify or discontinue the Free plan at any time.
Overages
If your usage exceeds the limits of your plan, we will notify you and may throttle or block requests until the next billing cycle or until you upgrade.
4. Intellectual Property
Deflector and its licensors retain all rights in the Service, including all software, algorithms, documentation, and branding. These Terms do not grant you any ownership rights — only a limited, non-exclusive, non-transferable license to use the Service during the subscription term.
You retain ownership of your site data, API keys, and configuration. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.
5. Confidentiality
You agree to keep confidential any non-public technical or business information about the Service that you learn through your use of it. We will keep your site-specific data confidential in accordance with our Privacy Policy.
6. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect all bots or block all scraping activity.
7. Limitation of Liability
To the maximum extent permitted by law, Deflector's total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the fees you paid in the 12 months preceding the claim. In no event will Deflector be liable for indirect, incidental, special, consequential, or punitive damages.
8. Indemnification
You agree to indemnify and hold harmless Deflector, its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
9. Termination
Either party may terminate the subscription at any time. You may cancel through the billing portal in your dashboard. Upon termination, your access to the Service will end at the conclusion of the current billing period. We may terminate your account immediately for material breach of these Terms.
Upon account deletion, we will delete your data within 30 days, except where retention is required by law or for fraud prevention.
10. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising out of these Terms will be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
11. Changes to These Terms
We may revise these Terms at any time. We will notify you of material changes by email or through the dashboard at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
